Terms & Conditions
PROGRAM TERMS AND CONDITIONS (“Terms”)
for Tourico Holidays, Inc. dba Walking With the Prophets (“Walking
With The Prophets”) and the end-user and/or agent of the
end-user (“Consumer”) for tours to Israel via third
party vendors and suppliers of travel inventory and related products
(“Suppliers”).
ACCOMODATIONS/LUGGAGE: Single/Double Occupancy; luggage limits
and handling
PAYMENT: A deposit of $200.00 per person is payable at the time
of booking. Payment for airline tickets is payable 14 days after
booking. The balance and final payment for the tour, including
payment for airline tickets, is due 70 days prior to departure.
Price does not include personal and miscellaneous charges, including
but not limited to, gratuities, passport/visa fees, laundry, excess
baggage, travel insurance, and food and beverages unless specifically
noted.
SPECIAL TRAVEL REQUREMENTS: The hotels, tourist facilities and
airlines featured may not have the appropriate special services
and equipment to accommodate persons with disabilities or special
needs. Please advise Walking With The Prophets of any special
requests at the time of booking and we will forward the request
to the appropriate Supplier. Fees and charges for special services
may apply. Such requests are treated as requests only and cannot
be guaranteed by Walking With The Prophets.
ITINERARY: Flight schedules are subject to change by Suppliers.
Walking With The Prophets reserves the right to lengthen or shorten
the itinerary accordingly. Additional fees for accommodations
are the responsibility of the Consumer.The itenarary is subject
to change at any time.
CANCELLATIONS AND CHANGES: All bookings are subject to cancellation
fees based upon the greater of the total cost of the cancelled
booking, including any reserved add-ons, or the cost to Walking
With The Prophets for the cancelled booking including reserved
add-ons (“Cost”) as follows: (1) 60+ days prior to
departure - $200.00; (2) 45-59 days prior to departure - 15% of
the Cost ; (3) 30-44 days prior to departure - 25% of the Cost
; (4) 15-29 prior to departure – 50% of the Cost and (5)
14 days or less days prior to departure – 100% of the Cost.
All cancellations must be made in writing and by certified mail
to Laurie Krupa, 220 East Central Pkwy, Suite 4010, Altamonte
Springs, FL 32701. All changes made to existing reservations are
subject to change fees as determined by Walking With The Prophets.
No refunds or exchanges will be made for any unused package or
components. No refunds will be provided for lost, destroyed or
stolen documents or tickets. All refunds are subject to the above
provisions governing cancellations, including applicable fees,
and are further subject to any such fees or other charges imposed
by Suppliers. Acceptance of a refund constitutes a waiver by the
Consumer of all rights and remedies under applicable law other
than the amount of the refund.
LIMITATION OF LIABILITIES: WALKING WITH THE PROPHETS SHALL NOT
BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, ECONOMIC
OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING BUT NOT LIMITED TO PECUNIARY
LOSS, DAMAGES FOR LOSS OF PRIVACY, OR FOR FAILURE TO MEET ANY
DUTY, INCLUDING ANY DUTY OF GOOD FAITH, OR TO EXERCISE COMMERCIALLY
REASONABLE CARE OR FOR NEGLIGENCE) ARISING OUT OF THE TERMS AND/OR
TOUR EVEN IF WALKING WITH THE PROPHETS HAS BEEN ADVISED OF THE
POSSIBLITY OF SUCH DAMAGES. THIS LIMITATION SHALL BE EFFECTIVE
EVEN IF ANY REMDY FAILS OF ITS ESSENTIAL PURPOSE. IN NO EVENT
SHALL WALKING WITH THE PROPHETS BE RESPONSIBLE FOR ANY AMOUNT
OTHER THAN THE PRICE PAID BY THE CONSUMER FOR THE TRAVEL INVENTORY
AND PROGRAM.
Walking With The Prophets is not an agent of the Suppliers. All
travel documents are issued subject to the terms and conditions
specified by the applicable Supplier. Walking With The Prophets,
its agents, and its employees shall not be held liable for and
by accepting such travel documents the Consumer waives any claim
against Walking With The Prophets, its agents, and its employees
for (a) any loss of or damage to property or injury to any person
caused by reason of any defect, negligence, or other wrongful
act or omission, or any failure of performance of any kind by
any transportation company, Supplier; (b) any inconvenience, loss
of enjoyment, mental distress or other similar matter; (c) any
delayed departure, missed connection, substitutions or termination
of service, or changes in fares and rates; (d) any loss or damage
due to strikes, wars, natural disasters, and closures, and (e)
any cancellation or double booking of reservations or tickets
beyond the control of Walking With The Prophets.
All goods and services are provided without any warranty of any
kind. To the extent permitted by law, any and all warranties of
any kind whatsoever, including implied or statutory warranties,
including but not limited to those of merchantability, of fitness
for a particular purpose, of accuracy or completeness of information,
reasonable care, and of lack of negligence are excluded.
Enrollment in and payment for the tour constitutes your contractual
and binding acceptance of the Terms. The Terms shall be construed
and controlled by the laws of the State of Florida and you consent
to exclusive jurisdiction and venue in the courts of Seminole
County.
